Terms of Service

1. Agreement
These Terms of Service (“Terms”) form a legally binding agreement between you (“you,” “Guest”) and the owner and operator of Curran Lake House (“we,” “us,” the “Host”) governing your use of this website, the booking platform, and any stay you reserve through it (collectively, the “Service”). By creating an account, reserving a stay, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you may not use the Service.
2. Eligibility
You must be at least 18 years old and able to form a legally binding contract under the laws of your jurisdiction. If you book on behalf of others, you represent that you have authority to bind each guest in your party and that you will remain personally responsible for compliance with these Terms and the House Rules.
3. Bookings, pricing, and payment
All bookings are subject to availability and confirmation. Quoted rates include nightly charges, a cleaning fee, applicable taxes, and a refundable security deposit as disclosed in the price breakdown. Prices are charged in United States dollars and processed by PayPal. We are not a payment processor and do not store your card or bank details. By submitting a booking, you authorize us to charge the total reflected at checkout to your selected payment method. A booking is confirmed only after successful capture of the payment and, where required, verification of your photo ID.
4. Security deposit and damage
At the time of booking we charge a refundable security deposit separately itemized in the price breakdown. Within the time period disclosed at booking (typically within 48 hours after checkout) we will either (a) release the full deposit back to your original payment method, or (b) retain a portion to cover documented damage, missing items, excess cleaning, or violations of the House Rules, and refund the remainder. We will provide a written explanation and photographic evidence of any charge against the deposit. Retaining the deposit does not waive our right to recover additional amounts where actual damages exceed it.
5. Identity verification
The primary guest must upload a clear photograph of a valid government-issued photo ID (driver's license, passport, or equivalent) before check-in. We use this solely to verify your identity against the payment method, confirm you meet the minimum age, and comply with short-term rental regulations. The document is stored privately and purged 90 days after checkout except where retention is required to resolve a dispute or by law. See the Privacy Policy for details.
6. Cancellation and refunds
Our cancellation schedule is disclosed at booking and on the Cancellation Policy page. Cancellations are processed against the PayPal order that funded the booking; refunds typically appear within 5 business days. We may cancel a booking for cause (e.g., confirmed fraud, failure to complete ID verification, violation of the House Rules, or events outside our reasonable control) and will refund the portion of the stay that was not consumed.
7. House rules and occupancy
You agree to comply with the House Rules including maximum occupancy, quiet hours, no-smoking policy, and any restrictions on parties or events. Exceeding the stated maximum occupancy or hosting a party is a material breach and may result in immediate termination of the booking without refund.
8. Your conduct on the Service
You agree not to: (a) submit false, misleading, or impersonated information; (b) attempt to gain unauthorized access to the Service, other accounts, or the underlying infrastructure; (c) scrape, reverse engineer, or resell the Service; (d) upload viruses or harmful code; or (e) use the Service in violation of applicable law. You are responsible for maintaining the confidentiality of your account credentials. Each review you publish must reflect your genuine firsthand experience; only the author of a review may remove it.
9. Intellectual property
The Service, including all text, graphics, logos, photos, and source code, is owned by us or our licensors and protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive license to access and use the Service for its intended purpose. You retain ownership of content you submit (reviews, messages, ID documents); by submitting it you grant us a non-exclusive, royalty-free license to use that content solely to operate the Service in accordance with the Privacy Policy.
10. Disclaimers
The Service and the Property are provided “as is” and “as available.” Except where prohibited by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We make no warranty that the Service will be uninterrupted or error-free. Your stay involves waterfront activities that carry inherent risk; you assume responsibility for yourself and your guests on the property.
11. Limitation of liability
To the maximum extent permitted by law, our aggregate liability arising from or related to the Service or any stay shall not exceed the greater of (a) the amounts you paid us for the booking at issue in the 12 months preceding the claim, or (b) one hundred US dollars ($100). In no event shall we be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the limitation of incidental or consequential damages; in those jurisdictions our liability is limited to the greatest extent permitted by law.
12. Indemnification
You agree to defend, indemnify, and hold us harmless from any claim, liability, loss, or expense (including reasonable attorneys' fees) arising out of your use of the Service, your stay, your breach of these Terms, or your violation of any law or the rights of a third party.
13. Governing law and venue
These Terms and any dispute arising from them are governed by the laws of the State of Georgia, United States, without regard to conflict-of-laws rules. The exclusive venue for any dispute is the state or federal courts located in Putnam County, Georgia, and you consent to personal jurisdiction there.
14. Informal resolution and arbitration
Before filing suit, you agree to contact us and attempt to resolve the dispute informally for at least 30 days. For any claim not resolved informally, you and we agree that the dispute (other than claims for injunctive relief or claims within the jurisdiction of a small-claims court) shall be resolved by final and binding individual arbitration under the rules of the American Arbitration Association. You waive the right to participate in a class action or class arbitration.
15. Changes to these Terms
We may modify these Terms from time to time. Material changes will be communicated by email to the address on your account and by posting the updated Terms with a new effective date. Continued use of the Service after the effective date constitutes acceptance. The version of these Terms in effect on the date of your booking governs that booking.
16. Account termination
We may suspend or terminate your account if you materially breach these Terms. You may delete your account at any time by contacting us; deletion does not cancel confirmed bookings or release you from obligations accrued before deletion.
17. Severability and entire agreement
If any provision of these Terms is held unenforceable, that provision shall be modified to the extent necessary to make it enforceable, and the remaining provisions shall continue in full force. These Terms, together with the Privacy Policy and House Rules, constitute the entire agreement between you and us regarding the Service and supersede all prior communications.
